### Credit Report and Information Verification Consent

You acknowledge that you have requested your rates for a loan from Customers
Bank. For a period of up to 12 months following your initial request, you
authorize Customers Bank to obtain your consumer report and related
information about you from one or more consumer reporting agencies. Customers
Bank may use your consumer report for any legal purpose, including
authenticating your identity, making decisions related to your loan, sending
you invitations to apply or making follow-up loan offers, and servicing or
collecting any loan that you receive.

For New York, Rhode Island and Vermont Residents: A consumer report may be
obtained from a consumer-reporting agency in connection with your application.
Upon your request (i) you will be informed whether or not consumer reports
were obtained and (ii) if reports were obtained, you will be informed of the
names and addresses of the credit reporting agencies that furnished the
reports. A consumer report may also be requested or used in connection with
any renewals or extensions, reviews or collection actions, or other legitimate
purpose associated with any loan we may grant you.

#### Identity Verification

To help the government fight the funding of terrorism and money laundering
activities, Federal law requires all financial institutions to obtain, verify,
and record information that identifies each person who opens an account. As a
result, under our customer identification program, we must ask for your name,
street address, mailing address, date of birth, and other information that
will allow us to identify you.

#### Application Verification

You authorize Customers Bank to verify any information in your online
application through third party databases or by contacting third parties,
including your college and any prior employers. Further, you acknowledge
Customers Bank may also ask to see your driver’s license, your college
transcripts or other identifying or supporting documents at any time.

Please note Customers Bank may terminate consideration of, or decline, your
application at any time for any reason. If Customers Bank elects to do this,
and you have not withdrawn your consent to electronic communication, Customers
Bank will provide a notice to you in the customersbank.upstart.com website
message box (a link on the website toolbar after you log-in), and by sending
it to you at the email address you registered with on the
customersbank.upstart.com website. In the event that electronic communication
consent has been withdrawn, the notice will be mailed to the address provided
in your application.

Electronic Communications Policy and Consent

In connection with your loan inquiry and any loan transaction, you are entitled by law to receive certain information on paper. By providing this consent, you agree to receive them electronically instead. You agree and consent to receive electronically all communications, agreements, documents, notices and disclosures (collectively, **"Communications"**;) that we, Upstart Network, Inc. (**"Upstart"**), and/or Customers Bank, including our affiliates and subsidiaries or our agents, successors and assigns, or service providers, provide in connection with any loan inquiry, loan offer, loan, or any other products or service you receive from Customers Bank on [www.upstart.com] or any of its subdomains, and the servicing of any loan you receive from Customers Bank. Your consent gives permission to communicate with you electronically in regard to any activity related to the Customers Bank product and services accessed through the website(s), and is not specific to any loan, inquiry, product, service, or transaction.

Communications include, as applicable:
- Any information provided to you about any loan inquiry or loan offers, including your interest rate, finance charges and APR, and the final terms of your loan;
- Any information provided to you about any product, service, or transaction you receive;
- Any terms and conditions and policies you agree to, including updates to these agreements or policies, and other authorizations you provide;
- Any documents or disclosures provided to you, including payment receipts, notices of default, and 
federal and state tax statements; and
- Any other information relating to your relationship to Upstart and Customers Bank.


We will provide these Communications to you by posting them on the Customers Bank website after you log-in, and/or by emailing them to you at your registered email address. It is your responsibility to keep your registered email address up to date so that we can communicate with you electronically. You have the right to request paper copies of any communication. Paper copies can be requested by calling 833-400-6767 during our operating hours 6:00 AM PST to 5:00 PM PST, each Monday through Friday that are Business Days. We do not charge a fee for paper copies. 

In order to access and retain electronic Communications, you will need: a computer with an Internet connection; a current web browser that includes 128-bit encryption and with cookies enabled (e.g. Microsoft Edge version 9.0 and above, Firefox version 87.0 and above, Chrome version 89.0 and above, or Safari 13.0 and above); a valid email address; and sufficient storage space to save past Communications or an installed printer to print them. You confirm that you have access to the necessary equipment and software to receive and save/print our Communications to you.

You have the right to withdraw consent and may withdraw your consent to receive Communications electronically, and to update your contact information we need to contact you electronically, by emailing us at customersbank.support@upstart.com; by calling us at (833) 400-6767 during our operating hours 6:00 AM PST to 5:00 PM PST, each Monday through Friday that are Business Days; or by writing to us via regular mail at Customers Bank Loan Operations, P.O. Box 1503, San Carlos, CA 94070. If you withdraw your consent prior to completing your application, you will not be able to complete the application process and therefore will not be issued a personal loan.

You acknowledge that we may amend this policy at any time by posting a revised version on our website. If we make a material change to this policy we will also send a notice to your registered email address.
